1. Definitions

For the purposes of this License, the following terms shall have the meanings set forth below:

1.1 “Software” shall mean the source code, object code, and any associated documentation or materials provided by the Licensor.

1.3 “User” shall mean any individual or legal entity that exercises rights under this License.

2. Grant of License

Subject to the terms and conditions set forth herein, the Licensor hereby grants to the User a limited, non-exclusive, non-transferable, and revocable license to use the Software solely for personal and non-commercial purposes. 6. Termination

This License shall automatically terminate, without prior notice, in the event that the User breaches any provision of this License. Upon termination, the User shall: (a) immediately cease all use of the Software; and (b) permanently delete and destroy all copies of the Software in the User’s possession or control.

THE SOFTWARE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY WHATSOEVER, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

9. Governing Law

This License shall be governed by and construed in accordance with the laws of the jurisdiction in which the Licensor resides, without regard to its conflict of laws principles.

10. Acceptance

By accessing, installing, copying, or otherwise using the Software, the User acknowledges that they have read, understood, and agree to be bound by the terms and conditions of this License.
